Scissor Lift Rental Terms & Conditions

By accepting this quote, taking possession of the equipment, or making payment, the Renter agrees to the following Terms and Conditions:

Equipment Responsibility

The Renter assumes full responsibility for the equipment from the time it is delivered, picked up, or otherwise placed in the Renter’s possession until it is returned to 1361448 B.C. Ltd. and inspected by 1361448 B.C. Ltd.

Damage and Loss

The Renter shall be responsible for any and all damage to the equipment during the rental period, including but not limited to damage caused by misuse, collision, overloading, improper transportation, vandalism, weather, negligence, operator error, or any other cause whatsoever. The Renter agrees to pay all repair costs, replacement parts, labour, transportation, administrative costs, and any loss of rental income resulting from such damage.

Theft and Non-Return

The Renter is fully responsible for the equipment in the event of theft, disappearance, seizure, loss, or failure to return the equipment. Should the equipment be stolen, lost, or deemed a total loss, the Renter shall be liable for the full replacement value of the equipment, including all associated transportation, administrative, inspection, recovery costs, and loss of rental revenue. The Renter must immediately report any theft to local law enforcement and provide 1361448 B.C. Ltd. with a police file number.

Safe Operation

The Renter acknowledges that only qualified, trained, and competent persons shall operate the equipment. The Renter shall ensure compliance with all applicable laws, regulations, safety requirements, manufacturer recommendations, and workplace safety standards.

Equipment Condition

The Renter acknowledges that the equipment has been inspected and accepted in good working condition prior to use unless otherwise noted. The Renter agrees to inspect the equipment upon receipt and immediately notify 1361448 B.C. Ltd. of any concerns.

Indemnification

The Renter agrees to indemnify, defend, and hold harmless 1361448 B.C. Ltd., its directors, officers, employees, representatives, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, fines, penalties, costs, and legal expenses arising out of or related to the possession, transportation, operation, misuse, storage, or use of the equipment during the rental period.

Limitation of Liability

Under no circumstances shall 1361448 B.C. Ltd. be liable for any indirect, incidental, special, consequential, or economic damages, including but not limited to loss of profits, project delays, business interruption, or loss of contracts arising from the use, malfunction, breakdown, or unavailability of the equipment.

Insurance

The Renter is responsible for maintaining adequate insurance coverage for damage, loss, theft, liability, and all risks associated with the equipment during the rental period. Proof of insurance may be required prior to equipment release.

Late Returns

Equipment not returned on the agreed return date shall continue to incur rental charges at the applicable daily rental rate until returned and inspected by 1361448 B.C. Ltd. Additional transportation, recovery, cleaning, repair, and administrative charges may apply.

Collection Costs

The Renter agrees to pay all costs incurred by 1361448 B.C. Ltd. in collecting overdue amounts, including legal fees, collection agency fees, court costs, and applicable interest charges.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.

Acceptance

Acceptance of this quote, payment of any rental invoice, or possession of the equipment shall constitute acceptance of these Terms and Conditions in their entirety.

The Renter expressly acknowledges that they are fully responsible for any loss, theft, damage, destruction, misuse, vandalism, or failure to return the equipment, regardless of fault, and agrees to reimburse 1361448 B.C. Ltd. for all resulting costs and losses.
